A job ending during probation affects more than salary. Understand immediate evidence, employer-linked permits, current job-search protection and where urgent advice belongs.

Start with four separate questions, not a panic assumption

If your Austrian job ends during probation, deal with employment rights, residence and work permission, benefits and insurance, and housing as separate workstreams. The employment ending does not mean every right disappears that minute, but the expiry date on a residence card is not permission to ignore the change either. Act promptly and establish your exact title, dates and circumstances.

This guide was reviewed on 15 October 2026 for ordinary employment situations. Apprenticeships, public-service relationships and special circumstances can involve different rules. It is orientation, not a determination of your right to stay or a substitute for urgent legal help. If you have a decision letter, an imminent permit expiry or evidence of discrimination, prioritise the competent adviser or authority rather than waiting for a paid relocation appointment.

Check whether there was a valid probation period

Arbeiterkammer explains that an agreed probation period in ordinary employment can generally last no more than one month, and a collective agreement may provide a shorter period. During a valid probation period either side can generally end the relationship without an ordinary notice period or a stated reason. A contract labelling several months as “probation” does not make all of that period valid probation.

Keep the contract, applicable collective agreement, start date and the message or letter ending employment. Record when you received the declaration, who gave it and the stated end date. The legal classification matters: probation termination, ordinary dismissal, resignation and mutual termination are not interchangeable. Do not rewrite or sign a resignation merely because an employer says it is simpler; obtain advice on what actually happened and what you are being asked to agree to.

Protect evidence and seek urgent help if discrimination may be involved

The absence of ordinary notice during probation does not permit prohibited discrimination. Arbeiterkammer identifies possible remedies for discriminatory termination and warns that challenging it can require action within two weeks. Do not use that period as permission to wait: seek advice immediately because the correct remedy, facts and deadline must be assessed for your case.

Save relevant correspondence, dates, witnesses and your own factual account. Preserve employment records lawfully; do not copy patient information, confidential business files or other people’s personal data as evidence for an unrelated dispute. If documents need translation for an adviser, keep the original wording alongside the translation. Ask Arbeiterkammer, your union or an appropriately qualified lawyer what can be challenged and what must be filed. A relocation consultant cannot bring a court claim simply by reviewing the file.

Identify the residence title: RWR, Blue Card and RWR Plus differ

A Red-White-Red Card and an Austrian EU Blue Card are linked to authorised employment, whereas a Red-White-Red Card plus provides unrestricted labour-market access within its residence framework. Losing an employer-linked job therefore raises a different question from losing a job while already holding an RWR Plus. Professional registration is another issue: a nurse still needs the appropriate authorisation for any new nursing role.

Contact the competent residence authority and AMS promptly with your title, card expiry, employment end date and any new offer. Ask what notification, application and evidence are needed and retain the written response. If family members rely on related residence arrangements, include that fact. Do not assume that an AMS benefits application also completes a residence procedure or that a recruiter can authorise a change of employer.

Current law provides job-search protection—but it is not unrestricted work permission

The consolidated Foreign Nationals Employment Act reviewed for this article, §20d(7) AuslBG, requires AMS to allow holders of specified titles, including the Red-White-Red Card and EU Blue Card, at least six months to seek work before notifying the residence authority that the employment-admission conditions are no longer fulfilled. The period runs from the beginning of unemployment; a statutory extension exists for specified exploitative employment circumstances.

This protection should not be confused with a new permit allowing any job or an automatic extension beyond every residence-title expiry. Ask AMS and the residence authority how it applies to your title, dates and any pending renewal. Keep the difference between permission to search and permission to start the next job explicit. Older articles or advice based on another country’s Blue Card can omit current Austrian protections or describe the wrong procedure.

A new job needs the correct employer-change process

The current federal migration guidance describes a new application for an employer-linked RWR change, with provisional work possible after a 45-day waiting period tied to a complete application. For an Austrian EU Blue Card change, it describes a 30-day route, or immediate provisional commencement after the relevant application where the qualifying twelve months of Austrian Blue Card employment have been completed. Incomplete documents can suspend the waiting period. These are conditional procedures, not permission to count days from the last job ending.

Before accepting a start date, confirm the application type, completeness, any AMS communication and the earliest lawful start for the particular new role. Preserve the submission evidence and explain the conditions to HR. A signed contract, a successful interview or a trial-shift invitation is not enough by itself. If your current card is RWR Plus, changing employer does not require the same employer-linked application, but residence validity and any professional requirements still matter.

Apply promptly to AMS; do not assume benefits are automatic

AMS instructs people seeking unemployment benefits to apply no later than the first day of unemployment, with the next working day allowed where that day is a Saturday, Sunday or public holiday. The application can be made up to three weeks before employment ends. Follow the current AMS procedure and ask for assistance promptly if you are unsure how to apply; late action can create gaps.

An application does not guarantee payment. AMS assesses insured work history, availability and other eligibility conditions, including the circumstances relevant to your status. A newly arrived worker should not budget on automatic benefits after a short first job. Arbeiterkammer also explains that voluntary termination can lead to an initial 28-day non-payment period, subject to consideration of relevant reasons. Distinguish an employer ending probation from you choosing to leave, and let AMS assess the documented facts.

Review the final pay, insurance and employer housing separately

Request the final payslip and relevant employment documents, and compare them with your records of hours, payments and outstanding amounts. Do not assume an immediate end removes entitlement to pay already earned. If there are deductions or a training-cost demand, obtain an itemised explanation and employment-law advice before acknowledging a debt. A document marked “settlement” or “all claims paid” deserves careful reading.

Confirm your actual insurance position with the insurer and AMS; having an e-card in your wallet does not establish ongoing coverage for every purpose. If housing came with the job, read its separate agreement and establish the move-out date, rent, deposit and any alternative arrangements. Inform relevant advisers if illness, dependants or imminent loss of accommodation makes the situation urgent. Do not assume a job-search period automatically provides salary, housing or insurance for the same length of time.

Build a practical first-days action file

Create one folder containing passport and residence-title details, the employment contract, termination evidence, payroll records, recognition and registration documents if relevant, housing terms and any new offer. Make a dated chronology from the first working day to the last communication. Keep a task list with separate entries for employment advice, AMS application, residence questions, insurance confirmation and housing. This helps each body answer the question within its responsibility.

For example, a hypothetical nurse whose job ends after three weeks may need urgent advice on the probation declaration, an AMS eligibility assessment, confirmation of the employer-change route and a written answer about staff accommodation. A pending interview does not complete those tasks. Maintain a realistic cash budget and target suitable employers while the administrative questions are answered; do not accept unauthorised work to bridge the gap.

FAQs and the limits of a relocation consultation

Must I leave Austria on the day the job ends? Do not assume that; establish your current title and applicable protection promptly. Can I start anywhere because my card is not expired? Not on that basis alone. Does six months of job-search protection guarantee benefits or renewal? No: those are separate assessments. Does a three-month probation clause make every termination in those months valid? No; have the contract and actual dates checked.

For a non-urgent relocation or new-offer planning review, Move to Austria’s €99 Initial Assessment can help organise your evidence and the questions for HR and the authorities. It is not emergency employment-law representation, a court appeal, a residence decision or an assurance that you may remain or start work. Use Arbeiterkammer, AMS, the competent residence authority and a qualified Austrian lawyer where appropriate; do not delay a deadline to book with us. If a new offer is already available, bring the full terms so the remaining relocation dependencies can be reviewed.
