A new job can require a new employer-linked permit. Learn the application sequence, complete-file waiting rule and contract checks.

First identify whether your card is employer-specific

The standard Austrian Red White Red Card authorises employment with the employer named in the application. A change to another employer during its usual two-year validity therefore requires a new application for a suitable employer-linked residence title. The Red White Red Card Plus is different: it provides unrestricted labour-market access. Read the exact title on your card before agreeing to a new start date or assuming that a colleague's experience applies to you.

The new position must independently meet the chosen category's rules. A high salary cannot rescue a missing qualification, and a shortage occupation label does not apply to every province or job description. Compare the prospective employer, workplace, duties, hours, gross pay and collective-agreement classification with the route under which the new application will be filed.

The new employer's file needs to be complete

Ask for a binding offer or contract, employer declaration and a named HR contact who will answer authority questions. Check that the legal employing company is the one shown on every document, not a recruiter or parent brand. If you will practise a regulated profession, confirm that the qualification recognition and professional registration cover the new duties. A nurse moving from an assistant role to a registered role may face both immigration and professional-scope questions.

Keep copies of the current card, passport, recent employment evidence, new offer, qualifications and relevant language certificates. The Austrian federal FAQ explains that incomplete material suspends the waiting period for a provisional start. For that reason, document the filing date and any missing-documents request rather than counting calendar days from the first email sent to an employer or agency.

Understand the 45-day provisional-start rule precisely

The current federal migration FAQ says that, after a new application for a residence permit with labour-market access is filed, a Red White Red Card holder may provisionally begin the new employment after a waiting period of 45 days. The period begins only when the documents required to review the application have been submitted in full; missing documents suspend it. It is not a universal permission to switch jobs 45 days after receiving an offer.

Ask the competent authority or appropriately authorised adviser how the rule applies to the exact application, and retain the filing confirmation and complete-file evidence. An employer should set the start date against that documented status. If the current card is expiring or you have stopped meeting its conditions, do not assume the employer-change rule resolves every residence issue. Align the new filing with any renewal deadline.

Coordinate resignation and the new contract

Read your existing notice period, probation rules and any repayment clause for training, relocation or housing. A new permit application does not cancel contractual duties to the current employer. Ask the new employer whether the offer remains open if the authority asks for more documents, and put the conditional start date in writing. Keep enough savings to cover a gap between last and first salary.

Avoid working for both employers under the assumption that a single employer-specific card covers two jobs. The migration FAQ states that a Red White Red Card is issued for one specific employer. If the new role is more suitable for a different title, such as an EU Blue Card, compare the conditions before choosing a filing route. Do not submit competing applications without checking the rules on simultaneous proceedings.

Know when the Plus card changes the answer

A worker who held the Red White Red Card and performed qualifying employment for at least 21 months of the preceding 24 may be eligible for the Red White Red Card Plus. Once issued, that card is not restricted to one employer. Eligibility for the Plus card is not the same as already holding it; do not advertise immediate unrestricted work rights merely because you expect to qualify in a few months.

If both an upgrade and a job change are approaching, compare the timelines rather than filing reflexively. A review should identify the current card, expiry date, qualifying months, proposed employer and complete evidence pack. The authority decides the new title. A consultation can help prepare the sequence and questions, but it cannot replace the official confirmation of when the new job may lawfully start.
