The employer is the initial applicant
Spain's ordinary initial residence and employee-work authorization is requested by the employer or an authorized business representative. It covers a third-country national aged over sixteen for employment lasting more than ninety days and less than five years. The future worker should not treat a signed offer, recruiter message or consular appointment as proof that the employer has filed or obtained the authorization.
The national employment situation matters
Recruitment can proceed when the occupation appears in the quarterly shortage catalogue for the relevant province, when public employment services confirm difficulty filling the vacancy, when the worker falls within a statutory exception, or in another recognized case such as applicable agreements. Employers should use the current catalogue and procedure; an old nationwide list is not reliable evidence.
Contract and employer evidence are examined
The signed contract must provide continuous activity during the authorization and make its start conditional on the permit becoming effective. Pay and conditions must follow applicable law and the collective agreement. The employer must be registered and current with tax and Social Security obligations, demonstrate solvency and provide company identity, representation and role-description evidence with form EX-03.
Permit, visa, entry and TIE form one sequence
The official decision period for the authorization is three months. After approval, the worker generally has one month from notification to the employer to apply personally for the visa. The consular stage requires the current local list, which normally includes passport, criminal-record certificate, medical certificate and fee. After entry, Social Security registration activates employment; the TIE is then requested within the applicable one-month deadline.
Verify the offer before sending money
Ask for the employer's legal name, tax number, signed conditional contract, applicable collective agreement, gross pay, workplace, hours and the filing receipt or case reference. Confirm who pays government fees and never pay a recruiter for a guaranteed approval. The Spanish authority—not an agency—decides the application, and regulated work may also require qualification recognition before lawful practice.
