Why the offer and employer declaration must match
For employer-linked Austrian work routes, the job offer is not a decorative attachment. It establishes the role that the authority and AMS assess. The employer declaration records specific future employment conditions. If the employer, workplace, duties, hours or remuneration differ across the advert, contract and form, the authority may need clarification and the legal route itself may change.
Audit the package before filing. Correcting one field early is easier than explaining conflicting documents after submission. Use the final legal employer name and Austrian workplace, not a recruitment brand or overseas affiliate. Confirm that the person signing for the company has authority and that the candidate receives a copy of every final document submitted in the case.
Identify the legal employer and genuine workplace
Record the company's registered name, address, registration details, HR contact and the entity that will pay salary and register social insurance. A multinational group's well-known name is not enough when the Austrian employing entity is different. Verify contact through the company's own website and do not send identity documents to an unconfirmed mailbox.
The workplace matters for the competent authority and for any regional shortage occupation. State the main work location and explain genuine travel, hybrid or multi-site arrangements. If the contract says Vienna while the proposed shortage route depends on a role in another province, resolve the inconsistency before the employer signs the declaration.
Define duties, qualification and occupation precisely
The contract should describe real duties, reporting line, hours and required qualification with enough detail to test the permit. For an EU Blue Card, the work must correspond to the qualifying education. For a shortage route, the job and completed training must fit the official shortage occupation. For Other Key Workers, qualification or special skills and the points evidence must support the proposed role.
Avoid generic descriptions copied from another employee. Map the candidate's degree, vocational training and experience to the actual tasks. If a profession is regulated, identify the Austrian recognition status and any condition before full practice. The employer should not promise a protected professional title while the candidate is authorised only for an assistant or supervised role.
Check gross salary with the correct 2026 rule
Use the threshold for the intended route. In 2026 an Other Key Worker must be offered at least €3,465 gross per month, while the EU Blue Card requires at least €55,678 gross annual salary including special payments. A shortage occupation uses the applicable statutory, regulatory or collective-agreement minimum and any required customary overpayment rather than those separate headline thresholds.
Document gross base pay, payment frequency, special payments, allowances, overtime treatment, working hours, collective agreement and classification. Do not use an estimated net salary to prove a gross threshold. Confirm which components the authority can count and make the figures consistent across offer, employment contract and employer declaration.
Make the start date conditional on authorisation
A contract can be signed before the residence title is issued, but the candidate should not start ordinary employment merely because an application is pending. Use a lawful condition tied to the necessary Austrian residence and work authorisation and, where relevant, professional recognition. Avoid a fixed unconditional start date that both parties know cannot be met.
Plan what happens if processing lasts longer than expected: whether the offer remains open, who updates the authority, and whether a revised start date needs a document. The federal migration FAQ describes approximately eight weeks depending on completeness and authority capacity, but that estimate is not a contractual guarantee and does not include every recognition or consular complication.
Review probation, repayment and relocation clauses
Read probation, notice, fixed-term, training-cost, recruitment-fee, relocation and housing clauses together. A repayment obligation can turn employer-paid language or moving support into a large debt if employment ends early. Ask for the amount, reduction schedule, triggering events and treatment when the employer terminates the relationship or the authority refuses the application.
Separate the employment contract from accommodation, agency and training agreements. Identify deductions and deposits and compare them with the promised gross salary. If a clause is unclear or high-risk, obtain advice from a professional authorised to advise on Austrian employment law. An immigration-planning review is not a substitute for legal contract advice.
Prepare the supporting evidence pack
For the candidate, organise passport, photograph, insurance evidence, qualification documents, work certificates, accepted language evidence and any police records requested. For the employment test, include the signed employer declaration, binding offer or contract and route-specific evidence. Originals, copies, German or English translations and legalisation may be required depending on the document and authority.
Create a cross-reference sheet: each points claim or eligibility condition should point to a numbered document. Add a salary calculation and occupation match. This prevents the common problem of a large file that still fails to prove one decisive element. Keep personal data secure and share the package only through a verified channel with a clear purpose.
Final pre-filing questions for employer and candidate
Confirm the permit category, filing authority, person filing, employer-declaration signatory, occupation, workplace, salary rule, points or degree match, recognition status, language evidence and conditional start. Ask who answers authority requests and how quickly. Both parties should retain the same signed versions and immediately flag any material change while the application is pending.
